Submission summary: Our work has involved highly complex and specialist litigation, which has led the establishment of important principles which protect the public (by removing the level crossing) and the public purse (through protecting public assets from TVG applications and ensuring that the developer pays for necessary level crossing closures where development is adjacent to the operational railway). The Level Crossing closure involved two planning inquiries, five applications to the High Court and an application to the Court of Appeal; the Leach Grove Wood matter was considered by the lower courts before being heard by the Supreme Court.
